App Terms & Conditions

1. Service Description and Regulatory Compliance

AGRIeGO™ is a proprietary digital platform owned, developed, and operated by Hawking Drone Sprayers Private Limited ("Company"). The platform enables the facilitation, administration, coordination, and execution of agricultural drone spraying services and related functionalities, including but not limited to service requests, scheduling, bookings, customer communications, memberships, referral and reward programs, notifications, and operational updates.

All drone spraying services provided through AGRIeGO™ are organized, managed, supervised, and executed exclusively by the Company and/or its duly authorized employees, pilots, operators, or contractors. The Company maintains full operational control over all services and retains sole discretion to accept, modify, reschedule, suspend, or cancel any service request.

Regulatory Compliance

The Company undertakes to conduct all drone operations in compliance with applicable aviation, agricultural, environmental, and safety laws, including but not limited to:

• Regulations, rules, advisories, and standard operating procedures issued by the Directorate General of Civil Aviation (DGCA), (CAA), or any other relevant aviation regulator having jurisdiction, including requirements relating to drone registration, pilot certification, airspace authorization, geofencing, flight permissions, and operational limitations.
• Applicable insecticide, pesticide, fertilizer, and agrochemical laws, including licensing, labeling, usage restrictions, storage, transportation, and application guidelines prescribed under relevant central, state, or local legislation.
• Environmental protection laws, occupational health and safety regulations, and any other statutory requirements governing agricultural spraying activities.

Compliance with such regulations is subject to prevailing governmental approvals, airspace permissions, weather conditions, site feasibility, and regulatory constraints at the time of service execution.

2. User Eligibility, Representations, Verification & Responsibilities

Access to and use of the App is strictly limited to individuals who are at least eighteen (18) years of age and who have the full legal capacity and authority to enter into binding contractual obligations under applicable law. By accessing or using the App, the user expressly represents, warrants, and covenants that they satisfy these eligibility requirements and will continue to do so for the duration of their use of the App.

The user acknowledges and agrees that they are solely and fully responsible for the accuracy, completeness, authenticity, legality, and continued validity of all information, data, and documentation provided or maintained through the App, including but not limited to personal identification details, land or field information, ownership or usage rights, banking or payment information, and contact details.

The Company reserves the right, at any time and at its sole discretion, to verify, audit, review, or require supporting documentation in relation to any information provided by the user, including for the purposes of compliance with applicable laws, regulatory requirements, internal risk controls, fraud prevention, or Know Your Customer (KYC) and Anti-Money Laundering (AML) obligations. The user agrees to promptly provide any information, clarification, or documentation reasonably requested by the Company for such purposes.

Failure to provide requested information, submission of inaccurate, misleading, outdated, or incomplete information, or any attempt to circumvent verification, audit, or KYC procedures shall constitute a material breach of these Terms. In such cases, the Company may, without prior notice and without liability, suspend, restrict, or permanently terminate the user's access to the App and related services.

The collection, use, storage, verification, and disclosure of user information shall be governed by the Company's Privacy Policy, which forms an integral part of these Terms. By using the App, the user expressly consents to the processing of their personal data, including identity verification and KYC-related processing, in accordance with the Privacy Policy and applicable data protection laws.

Any misrepresentation, omission, unauthorized use, or misuse of the App—whether intentional, reckless, or negligent—may result in immediate enforcement action, including account termination and any other legal or equitable remedies available to the Company under applicable law.

3. Translation of the Terms

AGRIeGO™ may provide translations of the English version of these Terms into other languages for user convenience. You understand and agree that such translations are provided solely for ease of understanding, and the English version of these Terms shall govern your relationship with AGRIeGO™.

In the event of any inconsistency, conflict, or discrepancy between the English version of these Terms and any translated version, the English version shall prevail and be legally binding.

4. Referrals, Rewards & Payments

All referral benefits, rewards, incentives, cashbacks, or payouts (collectively, "Rewards") offered through the AGRIeGO™ application are conditional, discretionary, and subject at all times to applicable eligibility criteria, internal checks, verification processes, compliance requirements, and the successful completion and validation of the associated service, to the sole satisfaction of AGRIeGO™.

Rewards, if approved, shall be credited only to the bank account or payment method duly registered and verified in the user's profile. Rewards are strictly personal, non-assignable, non-transferable, non-exchangeable, and may not be encashed, substituted, or transferred under any circumstances.

AGRIeGO™ reserves the absolute and unrestricted right, at its sole discretion and without prior notice, to approve, reject, delay, suspend, modify, withhold, reverse, recover, claw back, or cancel any Reward, in whole or in part, including after provisional display or communication, in cases including but not limited to:

• inaccurate, incomplete, misleading, or outdated user information;
• suspected or actual fraud, abuse, manipulation, collusion, or gaming of the referral or reward system;
• violation of these Terms, applicable policies, or any applicable law or regulation;
• technical, system, calculation, or human errors;
• failure, cancellation, dispute, or non-completion of the underlying service or transaction;
• regulatory, statutory, tax, banking, or governmental requirements; or
• operational, financial, or business constraints.

No Reward shall be deemed earned, vested, payable, or due unless and until it has been expressly approved and successfully credited by AGRIeGO™. The mere accrual, display, notification, or expectation of a Reward shall not create any right, entitlement, debt, or obligation on AGRIeGO™.

AGRIeGO™ shall not be liable for any delay, non-payment, or cancellation of Rewards arising from verification processes, banking delays, force majeure events, regulatory actions, or third-party service providers. Any applicable taxes, levies, duties, or charges arising from Rewards shall be solely borne by the user, and AGRIeGO™ may deduct or withhold such amounts as required under applicable law.

A. Program Overview

The AGRIeGO™ Referral Program enables registered users of the AGRIeGO™ application ("Referrer") to earn referral rewards by inviting new users ("Referred Users") to join the platform using a valid referral code.

B. Eligibility

• The referrer must be a registered and verified AGRIeGO™ user.
• The referred user must be a new user who has not previously registered on AGRIeGO™.
• Referral benefits apply only when the referral code is used during new user registration.

C. Referral Reward for Referrer

• The referrer is eligible to receive a referral reward for each successful referral, as per the current referral offer displayed in the AGRIeGO™ application.
• A referral is considered successful once the referred user completes registration using the referral code.
• Referral rewards may vary based on company promotions, campaigns, or offer plans in effect at the time.

D. Benefits for Referred User

• The referred user may receive promotional benefits, such as discounts or special offers, when booking AGRIeGO™ services using the referral code.
• The nature and value of such benefits shall be determined by AGRIeGO™ and displayed in the application at the time of booking.

E. Booking-Based Rewards for Referrer

First Booking Reward

The referrer may receive an additional reward when the referred user completes their first eligible booking, subject to minimum booking criteria as defined in the app.

Subsequent Booking Rewards

The referrer may receive additional rewards for subsequent eligible bookings completed by the referred user, subject to AGRIeGO™'s prevailing offer structure.

F. Repeat Referral Cycle

• Referral rewards apply individually for each referred user.
• Users may continue to earn rewards for multiple referrals, subject to these Terms & Conditions and applicable limits, if any.

4.1 Right to Modify, Suspend, or Terminate Referral Program

AGRIeGO™ reserves the absolute right, at its sole discretion and without prior notice, to modify, amend, suspend, restrict, discontinue, or terminate the referral program, rewards structure, eligibility criteria, payout mechanisms, or any related terms, in whole or in part, at any time and for any reason, including but not limited to legal, regulatory, operational, technical, or business considerations.

Such modification, suspension, or termination may occur without liability, compensation, or obligation of any kind to any user. Upon suspension or termination of the referral program, any unapproved, pending, accrued, displayed, or expected rewards shall automatically lapse and be deemed forfeited, unless otherwise expressly approved in writing by AGRIeGO™.

Continued use of the AGRIeGO™ application following any modification shall constitute the user's acceptance of the revised terms. AGRIeGO™ shall not be obligated to provide separate notice of such changes beyond updating the application or applicable policies, and users are responsible for periodically reviewing the terms.

5. AGRIeGO Membership Benefits for Farmers

While availing benefits under the AGRIeGO Membership Card (AgrieGO Card), the following terms shall be specifically applicable to registered farmer members:

• As a valid AgrieGO Card holder, the farmer shall be eligible to avail exclusive offers, priority access, and benefits on agricultural services executed directly by Hawking Drone Sprayers Pvt. Ltd. (HDSPPL) through the AgrieGO platform, including but not limited to drone-based agricultural services, advisory support, training programs, and allied agricultural solutions.
• AGRIeGO Membership benefits shall be applicable subject to minimum service requirements, eligibility conditions, or operational criteria as displayed on the AgrieGO platform. AGRIeGO reserves the right to revise such conditions from time to time at its sole discretion.
• The AgrieGO Membership benefits may be combined with other schemes, programs, or initiatives offered by AGRIeGO or Hawking Drone Sprayers Pvt. Ltd. (HDSPPL), including government-supported or institutional programs, unless expressly stated otherwise.
• Membership benefits shall not be applicable on services or activities that are:
  • Already provided at subsidized or government-fixed rates
  • Offered under special pilot programs, trials, or promotional initiatives
  • Provided at maximum retail price (MRP) or under bundled or discounted packages, unless explicitly mentioned
• Membership benefits can be availed only for services booked through the official AgrieGO platform and executed by Hawking Drone Sprayers Pvt. Ltd. (HDSPPL). Services availed outside the platform shall not be eligible for membership benefits.
• AGRIeGO and Hawking Drone Sprayers Pvt. Ltd. (HDSPPL) reserve the right to levy additional operational or logistics charges during periods of high demand, peak agricultural seasons, emergency requirements, adverse weather conditions, or services rendered in remote or difficult-to-access locations.
• Any additional charges collected are intended to ensure timely service execution and fair compensation to Hawking Drone Sprayers Pvt. Ltd. (HDSPPL) pilots, operators, technicians, and field staff, and to cover increased operational costs.
• The scope of services, service availability, geographical coverage, and applicable membership benefits may change from time to time. Members are advised to regularly review updates on the AgrieGO platform.
• AGRIeGO reserves the right to modify, suspend, or discontinue the AgrieGO Membership Card program, in whole or in part, at any time, with or without prior notice, at its sole discretion.

5.1 Execution of Services

All services available under the AgrieGO Membership Card shall be executed exclusively by Hawking Drone Sprayers Pvt. Ltd. (HDSPPL). AGRIeGO does not appoint or operate through third-party Service Facilitators for execution of services.

5.2 Membership Fees

To avail the AgrieGO Membership Card, farmers may be required to pay a membership fee based on the selected plan. The applicable fee, if any, shall be displayed on the AgrieGO platform at the time of enrollment.

5.3 Payments

Payments for purchasing or renewing the AGRIeGO™ Membership Card shall be made through payment methods available on the AGRIeGO™ platform. Membership activation shall be subject to successful receipt of payment by AGRIeGO™ or Hawking Drone Sprayers Pvt. Ltd. (HDSPPL).

All applicable taxes shall be included as per prevailing laws. AGRIeGO or Hawking Drone Sprayers Pvt. Ltd. (HDSPPL) may request additional information or documentation to comply with applicable legal or regulatory requirements.

5.4 Membership Term

These Terms shall commence from the date of successful enrollment or renewal and shall remain valid until the expiry of the selected membership plan.

5.5 Subscription, Renewal & Transferability

The AGRIeGO™ Membership Card is non-transferable and non-refundable, except as required under applicable law. Membership benefits are valid only for the registered farmer and associated agricultural land or activities.

5.6 Purpose of AGRIeGO Membership

The AGRIeGO™ Membership Card is designed to empower farmers by providing direct access to modern agricultural technologies, drone-based solutions, advisory services, and skill development programs executed and managed solely by Hawking Drone Sprayers Pvt. Ltd. (HDSPPL) through the AGRIeGO™ platform.

6. Service Execution & Safety Conditions

All drone spraying services are strictly subject to operational feasibility and may be impacted by weather conditions, statutory or regulatory approvals, airspace restrictions, safety requirements, site conditions, and physical accessibility of the service location. AGRIeGO™ reserves the sole right to postpone, modify, suspend, or cancel any service where such conditions are deemed unsafe, non-compliant, or operationally impractical.

A service shall be considered fully completed only upon actual execution of the spraying operation and successful internal verification and confirmation by AGRIeGO™. Any attempt, partial execution, delay, or non-execution caused by external factors beyond AGRIeGO™'s control shall not constitute service completion or breach.

Users, including farmers, landowners, or their representatives, shall bear full responsibility for accurately identifying and disclosing all sensitive, hazardous, or restricted areas within or near the service location prior to execution. This includes, without limitation, livestock areas, water bodies, wells, canals, power lines, telecom infrastructure, residential or public structures, and government-restricted or prohibited land.

AGRIeGO™ shall not be liable for any damage, loss, regulatory action, service failure, delay, or third-party claims arising directly or indirectly from the user's failure to disclose, misrepresentation, or provision of incomplete or inaccurate field information. The user agrees to indemnify and hold AGRIeGO™ harmless against all such claims, penalties, or consequences.

6.1 Simplified Farmer-Facing Version (Plain Language)

6.1.1 Service Execution & Safety Conditions

Drone spraying depends on many factors such as weather, government rules, flying permissions, safety conditions, and whether the field is accessible. AGRIeGO™ may delay or stop the service if conditions are unsafe or not permitted.

The service will be treated as completed only after the spraying is actually done and checked internally by AGRIeGO™.

Farmers must clearly inform AGRIeGO™ in advance about anything in or near the field that could be risky or restricted. This includes animals, ponds or wells, canals, electric lines, houses, roads, or government-restricted land.

AGRIeGO™ will not be responsible for any problems, damage, or delays caused because such information was not shared correctly or was incomplete.

7. Risk Factors, Disclaimers & Limitation of Responsibility

7.1 No Guarantee of Outcomes

Users acknowledge and agree that agricultural activities and outcomes are inherently uncertain and depend on multiple external and uncontrollable factors, including but not limited to weather conditions, soil characteristics, crop health, pest behavior, farming methods, and local environmental conditions.

AGRIeGO™ provides informational, analytical, and advisory tools only and does not guarantee any specific results, including but not limited to increased crop yield, pest elimination, disease prevention, or financial or economic benefit.

7.2 Disclaimer of Liability

To the maximum extent permitted by applicable law, AGRIeGO™ shall not be liable for any loss or damage, including but not limited to crop damage, loss of yield, loss of profits, data loss, or any indirect, incidental, special, or consequential damages arising from:

• Reliance on App-generated insights or recommendations
• Environmental, biological, or third-party factors beyond AGRIeGO™'s control
• User farming practices or decisions

Users remain solely responsible for evaluating and implementing any actions based on the App's outputs.

7.3 App Availability & Technical Limitations

AGRIeGO™ does not warrant that the App will be uninterrupted, error-free, or always available. App functionality may be temporarily suspended or limited due to maintenance, updates, system improvements, network failures, or other technical issues. AGRIeGO™ shall not be liable for any loss or inconvenience resulting from such interruptions.

7.4 Relationship to Privacy & Data Use

Nothing in this section limits or overrides AGRIeGO™'s obligations under its Privacy Policy. Data collection, processing, and storage practices are governed exclusively by the Privacy Policy, which forms an integral part of these Terms.

8. Advertising Services – Suspension & Termination

AGRIeGO™ may offer advertising and promotional services on the Platform in accordance with applicable service request forms, policies, and guidelines issued from time to time.

a. Termination with Notice

Either AGRIeGO™ or an advertiser may terminate any advertising arrangement by providing thirty (30) days' prior written notice, unless otherwise specified under an applicable service request form or policy.

Unless expressly agreed otherwise in writing:

• Any fees, advances, or prepaid amounts paid for advertising services shall be non-refundable.
• AGRIeGO™ may, at its discretion, permit utilization of any unutilized prepaid amount toward other advertising or promotional services on the Platform within a limited period, failing which such amounts may lapse.

b. Suspension or Immediate Termination

AGRIeGO™ reserves the right to suspend, restrict, or terminate advertising services, in whole or in part, with or without notice, if AGRIeGO™ reasonably determines that:

• The advertiser or advertisement violates these Terms, any applicable policy (including the Advertising Policy), or any law or regulation;
• The content is misleading, unsafe, non-compliant, or adversely impacts users, farmers, regulators, or the reputation of the Platform;
• The advertiser becomes insolvent, subject to winding-up proceedings, or ceases business operations; or
• Such action is required to comply with legal, regulatory, or governmental directions.

In such cases, AGRIeGO™ shall not be liable to refund any amounts already paid.

c. Effect of Termination

Termination or suspension of advertising services shall not affect:

• Any accrued rights or obligations of the Parties;
• Payment obligations, indemnities, disclaimers, or limitations of liability; or
• AGRIeGO™'s right to remove or disable access to advertising content.

9. Fraud, Abuse & Misuse

Users must not misuse the App or its services. Any attempt to manipulate, exploit, interfere with, or improperly use the App—including but not limited to fraudulent or self-referrals, false or misleading bookings, creation of duplicate or fake accounts, data tampering, unauthorized system access, circumvention of safeguards, or abuse of rewards, promotions, or incentives—is strictly prohibited.

AGRIeGO™ reserves the right to monitor and review activity on the App to ensure compliance with these Terms. If fraudulent, abusive, or improper activity is reasonably suspected or identified, AGRIeGO™ may take appropriate action, which may include cancelling or revoking rewards or benefits, restricting access to certain features, suspending or terminating the account, or reversing related transactions, in accordance with applicable laws and platform policies.

Where required, AGRIeGO™ may also report such activities to relevant authorities or pursue legal remedies. Any action taken will be proportionate to the violation identified. Decisions made by AGRIeGO™ regarding fraud, abuse, or misuse shall be final, subject to applicable laws and user rights.

10. Third-Party Services

AGRIeGO™ may integrate with, utilize, or depend upon third-party service providers for certain features or services, including but not limited to SMS delivery, OTP authentication, customer communications, banking interfaces, payment gateways, and related infrastructure. Such third-party services are provided on an "as-is" and "as-available" basis.

AGRIeGO™ does not own, operate, manage, or control these third-party systems and makes no representations or warranties, express or implied, regarding their availability, reliability, accuracy, security, performance, or continuity. While AGRIeGO™ exercises commercially reasonable diligence in selecting third-party providers, it shall not be liable or responsible for any delays, failures, errors, interruptions, data loss, unauthorized access, or service disruptions caused by or arising from the acts, omissions, systems, networks, or failures of such third parties, whether foreseeable or not.

To the maximum extent permitted by applicable law, AGRIeGO™ expressly disclaims all liability for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages resulting from or related to the use of, or inability to use, third-party services, even if AGRIeGO™ has been advised of the possibility of such damages. Any disputes, claims, or liabilities arising from third-party services shall be solely between the user and the respective third-party provider.

11. Limitation of Liability

AGRIeGO™ works to provide its services with reasonable care. However, AGRIeGO™ will not be responsible for indirect losses such as loss of profit, loss of data, or missed business opportunities that may happen while using the platform.

If AGRIeGO™ is found legally responsible for a problem, its responsibility will be limited as allowed under Indian law and will depend on the nature of the service and the amount paid by the user.

Nothing in these Terms takes away your legal rights as a consumer. AGRIeGO™ does not limit responsibility for serious issues such as fraud, willful wrongdoing, gross negligence, or any responsibility that cannot be excluded under the Consumer Protection Act, 2019 or other applicable laws.

12. Privacy & Data Protection

All personal and operational data collected through the App is processed in accordance with AGRIeGO™'s Privacy Policy and applicable data protection laws and regulations, including, where applicable, DPDP.

AGRIeGO™ implements appropriate technical and organizational measures to safeguard personal data against unauthorized access, alteration, disclosure, or destruction. Personal data is collected and processed solely for legitimate business purposes and in accordance with the principles of lawfulness, fairness, transparency, purpose limitation, and data minimization.

By accessing or using the App, users acknowledge that they have read and understood AGRIeGO™'s Privacy Policy and consent to the collection, processing, and storage of their data as described therein.

13. Linking and Framing

Users, Facilitators, advertisers, and any third parties may link to the AGRIeGO™ Services, provided that they acknowledge and agree that:

• The Services shall not be framed, embedded, or displayed within another website, application, or service without prior written authorization from AGRIeGO™; and
• The Services shall not be linked from or in association with any website, platform, or content that is:
  • Inappropriate, profane, defamatory, obscene, indecent, or unlawful
  • Infringing upon intellectual property, proprietary, privacy, or publicity rights
  • Misleading, harmful, or deceptive in nature

Any violation of this provision may, at the sole discretion of AGRIeGO™, result in the immediate suspension or termination of access to and use of the Services, without prior notice.

14. Jurisdiction and Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. The courts at Tiruvallur District, Tamil Nadu, shall have exclusive jurisdiction over all matters arising out of or relating to these Terms and the use of the AGRIeGO™ application.
